Terms of Use

By downloading or using Zouk ("the app"), you agree to these Terms of Use. If you do not agree, please don't use the app.
1. License
Zouk is licensed, not sold, to you. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial enjoyment on Apple devices that you own or control, in accordance with Apple's App Store Terms of Service (the "Standard EULA"), which is incorporated into these terms by reference.
2. Acceptable Use
You agree not to:
- Use the app in any way that could disable, overburden, damage, or impair it.
- Use any robot, spider, or other automatic means to access the app.
- Reverse-engineer, decompile, or attempt to derive the source code of the app, except where Apple's standard EULA expressly permits it.
- Use the app in environments where flashing lights or rapid color changes could cause harm. Zouk uses strobe-style effects and is not recommended for users with photosensitive epilepsy or related conditions.
3. Zouk Pro Subscription
Zouk Pro is an auto-renewable subscription that unlocks party hosting, party history, and advanced controls. The free tier ("Join Party") remains available without subscription.
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
- Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.
- Manage / cancel: You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
- Refunds: Refunds are handled by Apple in accordance with App Store policies. We cannot issue refunds directly.
4. Privacy
Your use of the app is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights.
5. Disclaimers
Zouk is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or network configuration. The app's beat detection and synchronization quality may vary depending on ambient noise, microphone hardware, network conditions, and other factors outside our control.
6. Limitation of Liability
To the maximum extent permitted by law, in no event shall the developer of Zouk be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the app, even if advised of the possibility of such damages.
7. Health Warning
Some of Zouk's effects involve flashing lights and rapid color changes. A small percentage of people may experience seizures when exposed to certain visual patterns or flashing lights. If you or anyone in your family has a history of epilepsy or seizures, consult a doctor before using the app. Stop using immediately and consult a doctor if you experience any of the following symptoms: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, or convulsions.
8. Changes
We may update these Terms from time to time. Continued use of the app after changes constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws applicable to the developer's place of residence, without regard to conflict of law principles.
